>>> breaking news. haitian judge says he will recommend releasing ten u.s. church members being detained on charges of child trafficking . the judge met with the group yesterday. miguel almaguer is in in port port-au-prince with the latest. why is he saying he might push to release them, miguel ?
>> reporter: contessa, yesterday the judge heard all the testimony and apparently wanted to hear from the americans . that wraps up the evidentiary hearing in this case. now all the evidence goes over to the prosecutor who will make a recommendation as to whether the americans should be tried or whether they should be set free . ultimately, though, it's the judge that makes the final decision here. it's the judge's decision as to whether the americans should face charges or whether they should be set free . he has reportedly said the americans should be set free . that has not become official yet because he still needs to hear back the official recommendation from the prosecutor. that could come as early as this afternoon. if that happens this afternoon and the judge makes his decision to set the americans free, they would walk out of the jail cell behind me as free citizens.
