Fenger Students Can Transfer, Says Judge

A federal judge ruled today that Chicago Public Schools must arrange transfers for Fenger High School students who want to change schools because they feel unsafe.

The ruling comes after 10 students filed a federal lawsuit against CPS, arguing their constitutional right to a public education was being deined because they were not allowed to transfer.

Following the much-publicized Derrion Albert beating death, students say they fear attending their high school.

"We believe we have responded to the tragedy and we are not preventing anyone from transferring," said Susan O'Keefe, CPS' general counsel, to Chicago Breaking News.

O'Keefe also offered students a chance to meet with CPS officials to arrange transfers.

The judge ordered the Chicago Board of Education to respond in writing by the end of the week.
