A man accused of beating a woman with a broom and choking her is out of the Osceola County Jail, but he's not supposed to be.
The Osceola County Jail made a mistake letting Axel Torres go, said Stacie Miller of the Kissimmee Police Department.
Three employees are on paid administrative leave as the jail scrambles to figure out how the clerical error was made.
A woman told Kissimmee police that the 48-year-old beat her with his fist and a broomstick and tried to choke her to death in front of her children. The woman escaped the next morning and went to police.
Police said that, while looking into the woman's claims, they found that Torres had an outstanding warrant for his arrest for being held in contempt of court. Police took him to jail while Kissimmee officer completed the necessary paperwork to book Torres on several other charges related to the woman's assault.
Someone within the jail released him when the newly filed charged should've held Torres on a no-bond status.
The jail said there was a clerical error made and that the clerk in the jail didn't have the right paperwork.
The jail administration is trying to figure out why.
"I don't know," Miller said. "I know that we delivered it within a timely fashion while he was still in jail. What happened from point when we delivered it and him getting out is probably a question for the jail."
Police are trying to find Torres to bring him back to the Osceola County Jail.
The victim has been taken to a safe house with her children.
