W.Va. Supreme Court to Hear Arguments in Marion County Murder Case

The West Virginia Supreme Court of Appeals is scheduled to hear arguments in the Lincoln Taylor murder case Jan. 13.
Taylor's defense attorney, Martin Sheehan, said each side will argue its case, and the court will make its decision some time after January.
Sheehan filed a writ of prohibition, arguing that retrying Taylor after a jury acquitted him of conspiracy charges would be double jeopardy.
Special Prosecutor Dan Dotson disagrees.
Taylor's third trial is set to begin Jan. 18.
Sheehan said he expects the judge to postpone it until after the Supreme Court makes its decision.
