Teen Charged With Super Sex Assault

New Charge Escalates Minimum Punishment If Convicted

CROSBY, Texas - A teenager has been accused of sexually assaulting a 12-year-old girl, leading law enforcement officers on a chase and trying to run down two deputy constables, KPRC Local 2 reported.

SWAT officers went to Joshua Gwyn's parents' Crosby home on Monday morning to take him into custody.

"She was forcibly sexually assaulted by the defendant," Assistant Harris County District Attorney Donna Hawkins said. "He also threatened her with serious bodily injury or death during the time of the sex assault."

Because he allegedly threatened the girl during the Oct. 4 attack, Gwyn, 17, is charged with super aggravated sexual assault of a child. A law passed in the last legislative session enhances the minimum sentence for anyone convicted of sexually assaulting a young child or using threats while sexually assaulting a child. If convicted, Gwyn would get a minimum sentence of 25 to life.

Those aren't the only charges Gwyn is facing. He has also been charged with aggravated assault of a public servant and evading arrest.

Two weeks ago, Gwyn was shot and wounded by Harris County Precinct 3 deputy constables after they said he led them on a 15-minute chase through Crosby.

Gwyn allegedly sideswiped a car at speeds over 90 mph, then tried to run down the deputy constables. The deputy constables fired eight rounds into the car, wounding Gwyn in the shoulder.

Investigators said Gwyn has confessed to the sexual assault, but Gwyn's attorney said Gwyn is innocent. Gwyn's attorney said Gwyn was questioned 24 hours after being shot and was on still on medication.

Gwyn is being held in the Harris County Jail with bond set at $100,000. He is expected to appear in court on Thursday.
