The Cass County Attorney said a man's speed and reckless driving caused the deaths of two Louisville brothers.
The attorney has filed motor vehicle homicide charges against Brandon Heanue, 23. He opted not to have Heanue arrested, instead setting a court date for him next month.
Michael and Kyle Matchus were killed in June when their truck flew off a highway near Southbend and crashed through a fence. The crash also left a young woman paralyzed.
The Cass County sheriff said Heanue's truck was passing the brothers' vehicle when the wreck happened. The accident report said Heanue passed the brothers' pickup in a no-passing zone and attempted to move back into the proper lane too soon, causing the Matchus vehicle to lose control.
"Shortly after leaving the roadway, the vehicle started to roll over several times," said Deputy Sheriff Karl Boehm, who reconstructed the crash. "It struck a tree in the middle of a vacant lot, continued rolling through a chain-link fence and struck another tree, where it came to rest on its top."
Michael Matchus died at the scene. His brother Kyle Matchus died four days later.
The court complaint said speed and reckless driving caused the brothers' deaths. The report said that both drivers were speeding and "willfully reckless."
"I came up with a speed of over 80 mph on the vehicle involved," said Boehm.
A memorial still marks the crash site. Many people who live in the area said they were still too emotional to talk about it.
"The whole town was shaken up by this," Boehm said.
