Man Fatally Shot After Police Respond To Robbery

The fate of a Gonzales police officer who shot and killed a man while responding to a reported robbery is now in the hands of the state's attorney general.

Officer Pete Austin opened fire on Marcos Valdez, 31, after perceiving a threat during when officers responded to a report that Valdez took $160 from his mother.

A deputy district attorney said on Wednesday that her office wrapped up an investigation and sent the report to the attorney general's office for further review.

It will be up to Attorney General Jerry Brown to determine if Austin committed a crime or not.

The shooting took place in September when three officers went to a home in the 700 block of Jersey Drive after receiving a call from Valdez's family members, who said they just wanted Valdez to be cited.

Austin, who is a 14-year veteran of the Gonzales Police Department, and the other officers involved were placed on administrative leave following the shooting. It is unclear if the officers have been permitted to return to the force.

Valdez left behind three children who are 1, 2 and 10 years old.
