Summit County Prosecutor Sherry Bevan Walsh's comment to Dateline

No Prosecutor ever wants an innocent person to remain in prison.  However, it would be irresponsible to recommend the release of someone convicted of murder and rape without a careful and thorough investigation.  Once our investigation was completed, we sought the immediate release of Clarence Elkins.  Since that time, old evidence is being re-examined, and new evidence is being uncovered.  We regret that we cannot provide the details of this investigation to Dateline NBC.  Prosecutors are bound by ethical rules requiring us to first present our evidence in a courtroom to ensure a fair trial.  Revealing details at this time may also jeopardize our ability to gain a conviction. We are continuing to invest time and resources to bring justice and closure for the victims and their family members.  We believe justice will be served after the investigation is complete.
